Abstract
There is considerable ambiguity surrounding the choice of an appropriate standard for evaluating employers' fair employment behavior. Unfortunately, the courts and compliance agencies have provided little clarification. This paper evaluates the Equal Employment Opportunity Commission's employment behavior as a possible standard for firms to emulate. Evidence suggests that the Equal Employment Opportunity Commission is overrepresented by blacks and underrepresented by whites when compared against two common evaluation standards. It is recommended that EEOC employment behavior nor be emulated.
